1. Overview
Earful Communications Platform LLC. (“Earful”), also referred to as “we” “us” and/or “our”, is a service (the “Service”) that allows vetted strangers to have a totally anonymous conversation. These Terms and Conditions and Privacy Policy (the “Terms”) govern your access and use of Earful. They make up the entire agreement between you and Earful regarding your use of our Service and supersede any prior agreements. You agree to our Terms of Service (“Terms”) by installing or using our apps, services, or website (together, “Services”).
1.1 How we fund our service
Earful charges a monthly subscription to use the Service. We use those funds to operate the service. We don’t collect personal data aside from what we need to operate the Service effectively and safely. We don’t sell personal data. We don’t offer advertising in our platform.
2. How the service works
Earful is a place to safely and anonymously share and hear from strangers. We believe this is important, because finding someone to simply talk through something that is neither grandiose nor completely trivial is difficult and tiresome to organize. Earful makes that connection simple and ephemeral. Something to talk about, or hear from someone on Earful, could be talking through something bothering you, getting an outsider’s perspective, simply sharing with someone something, and for the listener, a chance to participate in the stories and dramas of other people, and help them get through them.Our goal is to have enough users that, on demand, you can be matched with someone else to either listen to their story, or to share your story.
2.1 Anonymity built in from day 1
Earful is designed to never collect or store any sensitive information. Earful messages and calls cannot be accessed by us or other third parties because they are always end-to-end encrypted, private, and secure. Our Terms of Service and Privacy Policy are available below.Earful uses secure encryption to provide private internet calling to users who are Natural Persons in the United States of America.
3. About our services
3.1 Minimum Age Requirements
You must be at least 18 years old to use our Services. You must be willing to provide ID verification through our third-party partners, and agree to their terms. We use ID verification to ensure that all of our users are real, verifiable Natural Persons of USA who are 18 years or older.
3.2 Account Registration
To create an account you must register for our Services using your phone number. You agree to receive text messages and phone calls (from us or our third-party providers) with verification codes to register for our Services. You agree to use Earful to speak and share with other verified users through the Earful platform.3.3 Privacy of user data
Earful does not sell, rent or monetize your personal data or content in any way – ever. Any data that we collect or save is strictly for protecting our users, and for normal operation of the service and software on which it operates. We strive to store as minimal data as possible, and will continue to refine and update our privacy and data policies and practices to improve them, and make them better.
By reading this Privacy Policy and Terms and Conditions, you can better understand how we safeguard the information you provide when using Earful’s Services. For the purpose of operating our Services, you agree to our data practices as described in our Privacy Policy, as well as the transfer of your encrypted information and metadata to the United States and other countries where we have or use facilities, service providers or partners. Examples of Third Party Providers would be the service that sends you a verification code, our internal provider for processing support tickets, our ID verification partner, the underlying phone messaging service, our payment processing partner, and others. This list is not exhaustive, and we intend to expand this list and modify it, in order to give you and all users of Earful all assurances and protections reasonably possible.

In order to enable new features and enhanced functionality, you consent to downloading and installing updates to our Services.3.5 Fees and Taxes

4. Using Earful
4.1 Our Terms and Policies
You must use our Services according to our Terms and posted policies. If we disable your account for a violation of our Terms, you will not create another account without our permission.4.2 Legal and Acceptable Use
You agree to use our Services only for legal, authorized, and acceptable purposes. You will not use or assist others in using our Services in ways that could (a) violate or infringe the rights of Earful, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) involve sending illegal or impermissible communications such as bulk messaging, auto-messaging, and auto-dialing; (c) involve divulging information that could personally identify you, aside from your own, actual voice; (d) harm other users of Earful or Earful and its partners.
4.3 Harm to Earful
You must not (or assist others to) access, use, modify, distribute, transfer, or exploit our Services in unauthorized manners, or in ways that harm Earful, our Services, or systems. For example you must not (a) gain or try to gain unauthorized access to our Services or systems; (b) disrupt the integrity or performance of our Services; (c) create accounts for our Services through unauthorized or automated means; (d) collect information about our users in any unauthorized manner; or (e) sell, rent, or charge for our Services.
4.4 Keeping Your Account Secure
Earful embraces privacy by design and does not have the ability to access your calls on our services. You are responsible for keeping your device and your Earful account safe and secure. If you lose your phone, follow the steps on our Support site to re-register for our Services. When you register with a new device, your old device will stop receiving all messages and calls.No Access to Emergency Services. Our Services do not provide access to emergency service providers like the police, fire department, hospitals, or other public safety organizations. Earful is not a telephone service and is not intended to replace telephone service. Make sure you can contact emergency service providers through a mobile, fixed-line telephone, or other service.
4.5 Guidelines for what you can share and do on Earful
We want Earful to be a special, enriching, and dynamic community. We want people to have the security of anonymity, but with the knowledge that all other users are there with a similar purpose, to exchange stories and insight.Earful is a place to share interpersonal stories with anonymous strangers. It is an on demand service when you want to talk through something relatively inconsequential, but is important enough to warrant action, that is, the act of talking it through. For listeners, we hope they delight in hearing stories from other users, and helping them by simply hearing them, and at time, offering a different perspective.It is critical that all users abstain from sharing personally identifiable information, such as social security numbers, phone numbers, email, address, social handles like twitter, instagram, LinkedIn, Pinterest, YouTube, etc. Sharing personally identifiable information breaks the intent behind Earful.Furthermore, you may not use the Service to do or share anything:
• That violates these Terms and/or the Service
• That is unlawful, misleading, discriminatory or fraudulent (or assists someone else in using our Service in such a way).
• That you do not own or have the necessary rights to share.

6.4 Resolving Disputes and Ending Terms
Resolving disputes. You agree to resolve any Claim you have with us relating to or arising out of our Terms, us, or our Services exclusively in the United States District Court for the Eastern District of Michigan or a state court in Oakland County, Michigan. You also agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such disputes. The laws of the State of Michigan govern our Terms, as well as any disputes, whether in court or arbitration, which might arise between Earful and you, without regard to conflict of law provisions.
6.5 Ending these Terms
You may end these Terms with Earful at any time by deleting Earful Communications Platform from your device and discontinuing use of our Services. We may modify, suspend, or terminate your access to or use of our Services anytime for any reason, such as if you violate the letter or spirit of our Terms or create harm, risk, or possible legal exposure for Earful. The following provisions will survive termination of your relationship with Earful: “Licenses,” “Disclaimers,” “Limitation of Liability,” “Resolving dispute,” “Availability” and “Ending these Terms,” and “General”.

Earful may update the Terms from time to time. When we update our Terms, we will update the “Last Modified” date associated with the updated Terms. Your continued use of our Services confirms your acceptance of our updated Terms and supersedes any prior Terms. You will comply with all applicable export control and trade sanctions laws. Our Terms cover the entire agreement between you and Earful regarding our Services. If you do not agree with our Terms, you should stop using our Services.If we fail to enforce any of our Terms, that does not mean we waive the right to enforce them. If any provision of the Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable from our Terms and shall not affect the enforceability of the remaining provisions. 8. Additional Information about Privacy Policies and Practices
Earful utilizes state-of-the-art security and end-to-end encryption to provide private and anonymous, one-to-one Internet calling services to verified users to U.S. Natural Persons in the United States of America (“Services”). Your calls are encrypted, so they can never be shared or viewed by anyone but yourself and the intended recipients.8.1 Information you provide
8.1.1 Account Information
You register a phone number, email, and address when you create an Earful account. You also provide to our identity verification partners during sign up a valid form of identification. You will provide to our payment partners a valid form of payment. Earful will neither store nor access your payment information nor information about your identity, except as necessary to process your payment for the subscription to use the Services. Our partners may store payment information in order to process your payment to use the Services. We choose our partners because of their excellence in security and leadership in compliance with payment processing standards.
8.1.2 Calls
Earful cannot access the content of your calls. Calls are neither recorded nor stored, except as technologically necessary to transmit them between the sender and recipient, but only to that limited, technological requirement.Additional technical information is stored on our servers, including randomly generated authentication tokens, keys, push tokens, and other material that is necessary to establish calls and transmit messages. Earful limits this additional technical information to the minimum required to operate the Services.
8.1.3 Roles
A user will select a role, either as the person sharing, who is doing most of the talking or “giving an earful”, or as the person listening, who is talking only somewhat to gain clarification by asking questions, for example, also known as “getting an earful”.8.1.4 User Support
If you contact Earful User Support, [email protected], any personal data you may share with us is kept only for the purposes of researching the issue and contacting you about your case.
8.1.5 Managing your information
You can manage your personal information in Earful’s application Settings, principally with the option to delete your account with Earful.
8.1.6 Information we may share
Third Parties. We work with third parties to provide some of our Services. For example, our Third-Party Providers send a verification code to your phone number when you register for our Services. Furthermore, for example, our Third-Party Providers collect and securely store payment and billing information. An additional example of a Third-Party Provider is our ID verification partners, who verify the identity of our users during the sign up and registration process. These providers are bound by their Privacy Policies to safeguard that information. If you use other Third-Party Services in connection with our Services, their Terms and Privacy Policies govern your use of those services.
8.1.7 Other instances where Earful may need to share your data
To meet any applicable law, regulation, legal process or enforceable governmental request.
To enforce applicable Terms, including investigation of potential violations.
To detect, prevent, or otherwise address fraud, abuse, security, or technical issues.
